Loot Raiders Terms and Conditions

In this Agreement, the following terms have the meanings set forth below:

User | Any individual who creates an Account on Loot Raiders to participate in Giveaways or access additional features offered on the Platform. |
Community | An organization, brand, company, or individual that subscribes to Loot Raiders' SaaS platform to host, manage, and operate Giveaways. |
Giveaway | A promotional event organized through the Loot Raiders Platform, offering Users the opportunity to win Prizes. |
Services | The features, tools, technologies, and functionalities provided by Loot Raiders, including giveaway management, analytics, and community engagement. |
Platform | Refers collectively to the Loot Raiders website, mobile applications, APIs, and any associated software or services. |
Content | Any text, images, videos, data, or other materials created, uploaded, or shared by Users or Communities on the Platform. |
Account | A personalized profile created by a User to access and utilize Loot Raiders' Services. |
Fees | Subscription costs, licensing charges, or any other monetary obligations associated with accessing or using Loot Raiders' Services. |
Prizes | Items, rewards, tokens, or benefits Users may win by participating in Giveaways. |
EOAS INC SOCIEDAD DE RESPONSABILIDAD LIMITADA | The legal entity operating the Loot Raiders Platform, registered in Costa Rica under Identification Number 4062001334635. |
BETA Services | Features or functionalities offered on an experimental or trial basis, potentially including bugs, errors, or limited functionality. |
Prohibited Activities | Any actions forbidden under this Agreement, such as exploitation, hacking, fraud, or violation of community standards. |
SaaS-License | A subscription license purchased by Communities to access and utilize the Loot Raiders Platform for Giveaway management. |
Data Processing Agreement (DPA) | A binding agreement incorporated herein that governs the processing of Personal Data in compliance with data protection laws, particularly the GDPR. |
Personal Data | Any information related to an identified or identifiable natural person, including but not limited to names, email addresses, device IDs, and online identifiers. |
Intellectual Property (Rights) | All legal rights in and to Loot Raiders' technology, trademarks, service marks, designs, and proprietary content. |
Billing Cycle | The recurring monthly or yearly period for which subscription Fees are billed for a SaaS-License. |
Applicable Law | Refers to the laws governing this Agreement, particularly the laws of Costa Rica unless otherwise agreed. |
Section 2 – Applicability of Terms and Conditions
2.1 Binding Agreement
These Terms and Conditions constitute a legally binding agreement between you and Loot Raiders.
By accessing or using the Platform, including by creating an Account or purchasing a SaaS-License, you agree to be bound by this Agreement.
If you do not agree, you must immediately discontinue use of the Services.
2.2 Consent Prior to Account Creation
Before creating an Account, all Users must affirmatively accept these Terms and Conditions through an explicit consent mechanism (e.g., clicking "I Agree").
No Account may be created without full acceptance of this Agreement.
2.3 Supplemental Policies
Your use of the Platform is also subject to the following supplemental policies, incorporated by reference:
- Privacy Statement – governing the collection and processing of Personal Data
- Giveaway Policy – defining terms and obligations for Giveaways
- Code of Ethics – outlining expected behaviors and standards
- Complaints Policy – providing processes for dispute resolution
Where conflicts arise, the provisions of this Agreement prevail unless expressly stated otherwise.
2.4 Changes to the Agreement
Loot Raiders reserves the right to modify these Terms at any time.
Changes become effective upon posting on the Platform or, where legally required, upon direct notification to Users.
Continued use of the Services after updates constitutes acceptance of the revised Terms.
2.5 Jurisdictional Limitations and Age Restrictions
- Use of the Platform must comply with all applicable local, national, and international laws.
- Users must be at least 16 years of age.
- If under 18, Users must obtain parental or legal guardian consent to use the Services.
By using Loot Raiders, you affirm that you meet all eligibility criteria and are legally authorized to enter into this Agreement.
Section 3 – Users
3.1 Account Registration
To access Loot Raiders' Giveaways and community features, you must create a personal Account.
When registering, you agree to:
- Provide accurate and complete information (such as full name, email address, and any requested details).
- Keep your Account credentials confidential and secure.
- Notify Loot Raiders immediately if you suspect unauthorized access or misuse of your Account.
You must meet the eligibility criteria set forth in Section 2.5, including being at least 16 years old.
Accounts are personal and non-transferable.
By creating an Account, you also agree that your username and, where applicable, profile picture may be displayed publicly on the Platform to facilitate community engagement and Giveaway participation.
3.2 Access and Use of the Platform
Upon registration, you are granted a limited, non-exclusive, non-transferable license to use Loot Raiders' Platform and Services for personal, lawful purposes.
You agree not to engage in the following Prohibited Activities:
- Sending spam, phishing attempts, or unsolicited communications
- Hacking, exploiting vulnerabilities, or attempting unauthorized access
- Sharing or posting unlawful, harmful, defamatory, or objectionable content
- Violating any local, national, or international laws while using the Services
Loot Raiders reserves the right to suspend or terminate any Account found violating this Agreement or participating in Prohibited Activities, at its sole discretion.
3.3 Limitation of Liability and Exclusion of Users
Loot Raiders acts solely as an intermediary, providing a platform for Users and Communities to connect through Giveaways.
- Users acknowledge that Giveaway content, rules, and prize fulfillment are primarily managed by the Communities.
- Loot Raiders disclaims liability for the delivery or quality of Prizes awarded by Communities.
- Loot Raiders reserves the right to exclude Users from Giveaways or remove Users from Communities if they violate rules, engage in Prohibited Activities, or otherwise disrupt platform operations.
Objection Rights:
If you are excluded from a Giveaway or removed from a Community:
- You have 7 days to file an objection by contacting support@lootraiders.com.
- Loot Raiders will review all objections fairly and issue a final decision.
Winning Results & Prize Confirmation
- Winners of Giveaways are selected randomly according to the applicable Giveaway Policy.
- In case of calculation errors or system irregularities, Loot Raiders reserves the right to adjust results.
- If you are notified of winning a Prize, you must confirm acceptance within 24 hours of receiving the notification email.
- Failure to confirm within the deadline may result in prize forfeiture, and the Community may select an alternate winner.
Loot Raiders is not liable for missed emails, delayed confirmations, or Prize disputes.
Section 4 – Communities
4.1 SaaS-License and Terms of Use
Communities purchasing a SaaS-License are granted:
- A limited, non-exclusive, non-transferable right to use the Loot Raiders Platform solely for managing and hosting Giveaways.
Communities may not:
- Sublicense, resell, lease, or transfer Platform access without prior written consent.
- Use the Platform for unlawful or unauthorized activities.
Each Community is responsible for ensuring its Giveaways comply with all applicable laws and regulations.
4.2 Responsibilities of Communities
Communities must:
- Ensure the legal compliance of their Giveaways (e.g., sweepstakes laws, advertising regulations).
- Fulfill all obligations toward Prize winners, including delivery and taxes (if applicable).
- Follow all Platform policies, including the Giveaway Policy and Code of Ethics.
- Maintain free participation in Giveaways (no pay-to-enter mechanisms permitted).
Communities agree to indemnify and hold harmless Loot Raiders for any claims, fines, or disputes arising from their operations.
4.3 Data Processing and Privacy (DPA)
This Agreement includes a Data Processing Agreement (DPA):

Loot Raiders (Processor) | Processes Personal Data only on documented instructions and maintains strict data protection measures. |
Loot Raiders ensures:
- Data is encrypted, access is restricted, and processing complies with GDPR and other laws.
- Notification of Personal Data breaches without undue delay.
- Sub-processors are properly vetted and bound by equivalent obligations.
Communities remain responsible for ensuring lawful data collection practices and providing appropriate privacy notices to their Users.
4.4 Marketing and Promotions
Communities may:
- Use the Platform for marketing and brand engagement provided activities remain ethical and legally compliant.
Prohibited marketing practices include:
- Misleading advertisements
- Unauthorized endorsements
- Deceptive promotions
Use of Loot Raiders' trademarks or branding requires prior approval.
Personal Data obtained through the Platform must not be used for unrelated marketing purposes without explicit consent.
4.5 Exclusion of Users by Communities
Communities may exclude a User from a Giveaway or Community if:
- The User engages in Prohibited Activities
- The User violates Giveaway rules
- The User behaves disruptively
Communities must notify the User of the exclusion, and Loot Raiders retains final authority to confirm or overturn such actions if needed.
Users retain the right to object within 7 days by contacting support.
4.6 Responsibility for Prizes
Communities are fully responsible for:
- Prize procurement, delivery, taxes, and related costs
- Accurate and complete prize descriptions in their Giveaway terms
- Handling any disputes related to Prizes
Failure to fulfill Prizes may lead to account suspension or termination.
4.7 Platform Availability, Updates, and BETA Disclaimer
- Loot Raiders strives for maximum platform uptime but cannot guarantee uninterrupted access.
- During the BETA phase, features may be unstable, incomplete, or subject to change.
- Communities use BETA Services at their own risk and acknowledge possible disruptions.
4.8 Bug Reporting and Error Resolution
Communities are encouraged to report bugs or issues.
Loot Raiders will:
- Prioritize critical issues affecting platform integrity
- Communicate regarding major bug resolutions
- Disclaim liability for minor errors or unavoidable technical issues
4.9 Payments and Termination of SaaS-License

Cancellation | Can be initiated anytime; effective after current Billing Cycle. |
Refunds | 30-day refund available for new subscriptions only. No refunds for partial cycles. |
Termination by Loot Raiders | Possible for non-payment, breaches, or harmful behavior. Immediate access revocation upon termination. |
Section 5 – General Legal Provisions
5.1 Platform as an Intermediary and Moderation Rights
Loot Raiders acts solely as a neutral intermediary facilitating interactions between Users and Communities through the Platform.
- Communities are fully responsible for the creation, management, and lawful execution of their Giveaways, including Prize fulfillment.
- Loot Raiders retains the right to review, monitor, and moderate content, activities, and Giveaways hosted on the Platform to ensure compliance with this Agreement, the Giveaway Policy, and Applicable Laws.
Moderation Measures May Include:
- Suspending or terminating Accounts of Users or Communities who violate rules.
- Removing or disabling non-compliant or harmful content.
- Pausing, canceling, or modifying Giveaways that do not meet compliance standards.
Loot Raiders holds the final authority on moderation decisions, with the goal of maintaining the integrity, security, and reputation of the Platform.
5.2 Intellectual Property Rights
Loot Raiders, and EOAS INC SOCIEDAD DE RESPONSABILIDAD LIMITADA, retain all rights, title, and interest in:
- The Loot Raiders Platform
- Software, designs, trademarks, service marks, logos, and proprietary content
Unauthorized use, reproduction, modification, or distribution of Loot Raiders' intellectual property is strictly prohibited.
User and Community Content:
- Users and Communities retain ownership of the original content they upload or create.
- By uploading or creating content through the Platform, Users and Communities grant Loot Raiders a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content solely for the purpose of operating and promoting the Platform.
5.3 Limitation of Liability
Loot Raiders provides the Platform "as-is" and makes no warranties regarding:
- Uninterrupted or error-free access
- The reliability, completeness, or accuracy of Platform-provided data
Loot Raiders is not liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of data, revenue, profits, goodwill, or other intangible losses
- Content, actions, or omissions of Communities or Users
- Failure to deliver email notifications (e.g., Giveaway results) due to technical issues beyond its control
- Service interruptions caused by force majeure events, including cyberattacks, natural disasters, labor strikes, or regulatory actions
Participation in Giveaways does not guarantee winning, and Loot Raiders disclaims responsibility for Prize disputes, delivery failures, or execution errors attributable to Communities.
5.4 Governing Law, Jurisdiction, and Dispute Resolution
This Agreement is governed by, and construed under, the laws of Costa Rica.
Dispute Resolution:
- Parties agree to first attempt to resolve any disputes through good faith negotiations.
- If unresolved, disputes may be submitted to mediation or arbitration, if both parties consent.
- Otherwise, disputes will be brought exclusively before the courts of San José, Costa Rica.
5.5 Prohibited Activities
Strictly prohibited activities include:
- Unauthorized access attempts (hacking, exploiting vulnerabilities)
- Spamming, phishing, or sending unsolicited communications
- Uploading malicious software or harmful content
- Unauthorized use of Personal Data obtained through the Platform
- Engaging in fraud, deception, or manipulation related to Giveaways
- Violating any local, national, or international laws
Violations may result in:
- Immediate suspension or termination of Account or SaaS-License
- Legal action or reporting to regulatory authorities
- Forfeiture of winnings or access privileges
5.6 Affiliate and Brand Relationships
- Loot Raiders is not affiliated with, endorsed by, or partnered with any brands, products, or third parties mentioned in relation to Giveaways unless expressly stated.
- All trademarks and service marks referenced are the property of their respective owners, used solely for descriptive purposes.
Nothing in this Agreement creates an agency, partnership, or joint venture between Loot Raiders, Users, or Communities.
5.7 Miscellaneous Provisions
- If any provision of this Agreement is found to be invalid or unenforceable, the remainder will continue in full force and effect.
- Failure by Loot Raiders to enforce any right or provision does not constitute a waiver of that right or provision.
- Loot Raiders may assign its rights and obligations under this Agreement in the event of a merger, acquisition, or sale of assets.
- Users and Communities may not transfer or assign their rights without Loot Raiders' prior written consent.
- All provisions relating to intellectual property, limitation of liability, dispute resolution, indemnification, and confidentiality shall survive termination of this Agreement.
